1. About these terms
These Terms of Service apply when you use spintech.store or order products from Spintech.
Spintech is operated by Jacopo Crosti, a New Zealand sole trader trading as Spintech. Our New Zealand Business Number is 9429053587794. We are in trade and sell to customers in New Zealand.
In these terms, “Spintech”, “we”, “us” and “our” refer to Jacopo Crosti trading as Spintech. “You” and “your” refer to the person or organisation using the website or placing an order.
By placing an order, you confirm that you are at least 18 years old and have authority to enter into the transaction. If you order for an organisation, you confirm that you are authorised to bind that organisation.
2. New Zealand consumer rights
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other New Zealand law where that right or remedy cannot lawfully be excluded.
Consumer guarantees may include that products are of acceptable quality, match their description and are fit for a purpose that you make known to us and reasonably rely on us to assess.
3. Product information
We take reasonable care to describe Acemate accurately. Product images may show illustrative settings or accessories. The product supplied will be the model, inclusions and specifications stated in your order confirmation.
Acemate uses software and a mobile application. App features, interfaces and software-supported functions may change through manufacturer updates. We will not knowingly make a material change to the product you ordered without telling you and obtaining any agreement required by law.
Acemate is a training tool and not a replacement for professional coaching. Performance may be affected by court conditions, ball condition, shot speed, placement, setup and use. You must follow the manufacturer’s safety, charging, operating and maintenance instructions.
4. Price and payment
All prices are in New Zealand dollars and include GST unless we clearly state otherwise.
New Zealand delivery is included in the displayed Acemate price unless we clearly agree otherwise with you before accepting your order.
Payment is processed through the payment methods offered at Shopify checkout. We do not receive your full payment-card details.
5. Placing and accepting an order
Submitting an order is an offer to purchase the product on these terms. Your order is accepted automatically when Shopify sends the order confirmation.
If payment cannot be authorised, the order will not be completed. If we discover after acceptance that we cannot fulfil an order because of an obvious pricing or description error, suspected fraud, an address we cannot service or an unexpected inability to source the product, we will contact you promptly. We will offer an appropriate resolution, which may include cancellation and a full refund to the original payment method. We will act reasonably and will not cancel an accepted order merely to avoid our legal obligations.
6. Availability and delivery estimates
Orders may be accepted while local inventory is zero because Acemate units may be sourced after an order is confirmed.
The current estimated delivery period is approximately 10 to 14 calendar days after Shopify sends the order confirmation. This is an estimate, not a guaranteed delivery date. We will provide updated information if we become aware of a material delay.

7. Your order details
You must provide accurate contact, delivery and payment information. Contact hello@spintech.store promptly if anything is incorrect.
We will try to accommodate an address change requested before dispatch. We cannot guarantee changes after the order has been handed to the carrier.
8. Cancellations and change of mind
Once Shopify sends the order confirmation, Spintech does not offer cancellation, return, exchange or refund merely because you change your mind, your circumstances change or you find a cheaper alternative.
This does not affect rights or remedies available under New Zealand law, including for faulty, unsafe, misdescribed or unfit products.

9. Delivery, loss and damage
Spintech is responsible for resolving delivery problems with the carrier until the product is delivered to the address you supplied.
Inspect the outer packaging and product after delivery when reasonably practicable. If the product is missing, damaged or appears to have been damaged in transit, contact hello@spintech.store as soon as reasonably practicable with your order number and available photos. A prompt report helps us investigate, but does not replace or reduce any statutory right.
10. Setup, app access and third-party services
Spintech provides the setup guidance described in your order confirmation. Acemate app access and manufacturer-hosted services may also be subject to manufacturer terms and privacy practices.
Nothing in this clause removes Spintech’s responsibilities for representations we make, services we supply or statutory guarantees that apply to your purchase.
11. Warranty and support
Acemate provides a one-year limited manufacturer warranty starting on the date you receive the product.
Contact Spintech first at hello@spintech.store if you experience a product problem. Include your order number or other proof of purchase, the product serial number, a clear description of the issue and photos or video that show the problem where reasonably available.
Spintech will assess the issue, coordinate with Acemate manufacturer support where appropriate and provide any authorised return, inspection or collection instructions by email. The product may need to be inspected before the warranty outcome is confirmed.
The manufacturer warranty is additional to, and does not replace, rights under the Consumer Guarantees Act where that Act applies. Statutory rights may continue beyond the 12-month manufacturer warranty depending on what is reasonable for the product, its price and the circumstances.
12. Misuse and unauthorised repairs
Statutory remedies might not apply where a problem is caused by misuse, accidental damage after delivery, unauthorised modification, failure to follow reasonable operating instructions or a repair attempted without first giving Spintech a reasonable opportunity to assess the issue. This clause does not apply where New Zealand law provides otherwise.
13. Liability
To the maximum extent permitted by law, Spintech is not responsible for loss caused by your misuse of the product, failure to follow safety or operating instructions, or information you supplied incorrectly.
Spintech does not exclude liability that cannot lawfully be excluded. This includes applicable liability under the Consumer Guarantees Act and Fair Trading Act.
14. Website and intellectual property
The Spintech website, branding and original website content are owned by or licensed to Spintech. Acemate names, product material, software and manufacturer assets are owned by or licensed to their respective owners.
You may use the website for personal or internal business purchasing purposes. You must not reproduce, misuse, interfere with or commercially exploit website content without permission or another lawful basis.
15. Privacy
Our Privacy Policy explains how we collect, use, disclose and protect personal information. The Privacy Policy should be read with these terms.
16. Events outside reasonable control
If an event outside our reasonable control delays supply, we will contact you, take reasonable steps to reduce the impact and provide updated information. Your statutory rights and any right to a remedy for an unreasonable delay remain unaffected.
17. Complaints and disputes
Contact hello@spintech.store first so we can try to resolve the issue directly. Please include your order number, the outcome you seek and relevant evidence.
If we cannot resolve a dispute, you may have access to the New Zealand Disputes Tribunal or another applicable dispute-resolution process.
18. Changes to these terms
We may update these terms for future website use and future orders. The terms applying to an accepted order are the terms presented when that order was placed, unless you agree to a lawful change or a change is required by law.
19. Governing law
These terms are governed by New Zealand law. New Zealand courts and tribunals have non-exclusive jurisdiction, subject to any rights you have to bring a claim elsewhere under applicable law.
